Payment Terms and Conditions
1. Payment Due Date and Credit Period: 
Payment shall be made within 30 days from the date of invoice or delivery of the work, whichever occurs later. Delivery of the complete work shall be considered as the purchase of a product, and payment is due upon delivery. This 30-day period is a reasonable and standard allowance for commercial transactions, aligned with Maltese law and best business practices to ensure sustainability and prompt settlement.
2. Payment Method: 
Payments must be made via bank transfer to the account details provided on the invoice. Cheques will not be accepted.
3. Late Payment Interest and Fees: 
In the event of overdue payment, interest at the statutory rate (currently approximately 12.5% per annum) will be applied from the due date, calculated daily. A fixed late fee of €150 may be charged to cover administrative costs, where applicable.
4. Acceptance of Terms: 
By providing an email confirmation reply or otherwise proceeding with the quotation, the client fully accepts these quotation terms and conditions, including payment deadlines and late fee provisions.
Cancellation and Rescheduling
5. In the event of cancellation by the client, any deposit paid is non-refundable.
6. Rescheduling must be requested at least 72 hours prior to the photoshoot to avoid additional fees. Failure to provide a minimum of 72 hours’ notice for rescheduling will result in a fee equal to 50% of the total quoted price.
7. On the day of the shoot, if the client is unsatisfied with weather conditions, the photographer must be informed at least 1 hour before the scheduled time. If no notification is received, the shoot will proceed under existing conditions. Any additional photographs required under different weather conditions will be considered extra.
Notes
8. It is the client’s responsibility to review and be aware of the photographic style, based on portfolio examples at www.shaunspiteri.com. Unless the final images significantly differ from previous portfolio work, the client agrees to settle the final invoice upon image transfer.
9. The client is responsible for organising any interior or exterior styling required prior to the shoot. The photographer is not responsible for supplying styling items or ensuring the location is clean or prepared. Additional time spent onsite due to unprepared locations will be invoiced separately.
10. The photographer will retain high-resolution photos for 1 year after delivery. After this period, the photographer may permanently delete the images. It is the client’s responsibility to secure copies once images are transferred.
11. Photos are generally delivered within one week from the final photoshoot date, unless otherwise agreed.
Copyright and Usage Rights
12. Copyright of all photographic works remains with the photographer. The client is granted a non-exclusive license to use the images for agreed purposes only. Any other use requires the photographer’s prior written consent.
Liability and Limitation
13. The photographer shall not be liable for any indirect, consequential, or incidental damages. The client agrees that the photographer is not responsible for factors beyond their control including, but not limited to, weather, delays, or technical issues affecting the shoot or delivery.
Force Majeure
14. Neither party shall be liable for failure or delay in performing obligations due to circumstances beyond their reasonable control, including but not limited to natural disasters, government actions, or pandemics. Rescheduling or cancellation terms under this condition will be mutually agreed.
Privacy and Data Protection
15. The photographer complies with GDPR and any client data collected shall be handled confidentially and used solely for the purpose of providing photographic services.
